Saloonkeeper tests
anti-smoking ticket
MARYSVILLE (2/26/03) -- A bar owner's day in court to fight a legal citation for allowing smoking on her premises has been scheduled for April 1 -- April Fools Day.
The citation was the third such ticket June A. Johansen has been issued since Yuba County began enforcing its state-mandated anti-smoking ordinance last year, county tobacco compliance officer Peggy Reichardt said Wednesday.
If convicted, Johansen could be fined $500. Worse, her three-time loser conviction would be automatically noticed to the state Alcoholic Beverages Control agency and to the Occupational Safety and Health Administration, Reichardt said.
"OSHA would conduct a serious inspection and ABC can give very expensive tickets," Reichardt.
Johansen vowed in January to fight the ticket, contending the ticket was unfairly and incorrectly issued.
A Yuba County judge has set her trial for 1:30 p.m. April 1. Reichardt reported.
