MARYSVILLE 8/27/02 (YSN) -A Yuba County judge has sentenced John J. Cheso, 24, of Linda to 16 months in state prison for beating a 12-week-old puppy to death for chewing on a video game, officials said Tuesday.

Cheso had entered a negotiated plea of no contest July 26 to one felony count of animal cruelty in exchange for the limited term, Yuba County Deputy District Attorney Laurence Sager said.

A former live-in girlfriend who allegedly witnessed the Feb. 23 incident claimed that, in a fit of rage, Cheso grabbed their 16-pound Rottweiler female mix by the scruff of its neck, lifted it over his head and slammed it forcefully to the floor, Sager said.

"He spiked it like a football," said Sager, who decried the brutality of the act.

The dog apparently suffered several broken bones and internal injuries, bleeding through its nose for some 45 minutes before dying of its injuries. Cheso buried the dog in his backyard, but sheriff's investigators retrieved it a few daysn later when they searched Cheso's Sartori Avenue residence and grounds.

"This is the Yuba County equivalent of that highly publicized case in the Bay Area where someone dragged a woman's dog out of her car and threw it into traffic," Sager said.

At his sentencing Monday, Cheso expressed remorse over the incident, but Superior Court Judge James Curry denied his request for greater leniency, Sager said.

Cheso was already on probation for his April 5, 2001 conviction in Eastern District Federal Court on fraud charges he and an accomplice sold more than 100 counterfeit social security cards and immigration papers to illegal aliens in May, 2000, Sager said.
