Suspect freed
in fatal shooting

YUBA CITY 12/20/02 (YSN) -- A 40-year-old man being held in the Sutter County jail in connection with the a fatal shooting of Lynn B. Waters Jr. has been released in the interest of justice, authorities reported Friday.

Police arrested Rodney D. Hentzen about 4:30 p.m. Wednesday at his residence at boat dock trailer park at 80 Second Street after finding Waters lying in front of Hentzen's residence with a gunshot wound to his head, Yuba City police Lieutenant Bill Ollar said.

Waters, 36, who also lived in the trailer park, was transported to Sutter Hospital in Roseville where he was pronounced dead Thursday, Ollar said.

Hentzen was booked into jail on an initial charge of attempted homicide. However, he was released Friday by order of the Sutter County District Attorney's Office, a jail spokesman said.

The district attorneys order cited Penal Code section 849, which allows suspects to be freed when "there are insufficient grounds for making a criminal complaint," the jail spokesman said.

Assistant District Attorney Frederick Schroeder refused to take telephone calls about Hentzen or to authorize anyone else to speak about the matter, a receptionist said.

Witnesses told police Waters had been drinking and the two men had argued earlier in the day and was "basically hassling Hentzen," Ollar said.

At the time of the shooting Hentzen was inside his trailer and Waters was outside banging on the door and shouting, Ollar explained.

"The door came open and the victim was shot" with a .22-caliber handgun, Ollar said.
